This agreement applies as between you, the User of this Web Site and Gentle Drive Ltd, the owner(s) of this Web Site.  Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the Web Site. If you do not agree to be bound by these terms and conditions, you should stop using the Web Site immediately.

  2. Subject to sub-clause 2.3 you may not reproduce, copy, distribute, store or in any other fashion re-use material from the Web Site unless otherwise indicated on the Web Site

You agree that, if you have provided Gentle Drive with personal data relating to a third party (1) you have in place all necessary appropriate consents and notices to enable lawful transfer such personal data to Gentle Drive and (2) that you have brought to the attention of any such third party the Privacy Notice available on the Gentle Drive’s website or otherwise provided a copy of it to the third party. You agree to indemnify Gentle Drive in relation to all and any liabilities, penalties, fines, awards or costs arising from your non-compliance with these requirements.

    However, in the event that any of these terms are found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed from these terms and conditions
    and shall not affect the validity and enforceability of the remaining terms and conditions.  This term shall apply only within jurisdictions where a particular term is illegal.

8. NO WAIVER

In the event that any party to these Terms and Conditions fails to exercise any right or remedy contained herein, this shall not be construed as a waiver of that right or remedy.

9. PREVIOUS TERMS AND CONDITIONS

In the event of any conflict between these Terms and Conditions and any prior versions thereof, the provisions of these Terms and Conditions shall prevail unless it is expressly stated otherwise.

10. NOTICES

All notices / communications shall be given to us either by post to our Premises (see address above) or by email to info@salt-switch.co.uk
Such notice will be deemed received 3 days after posting if sent by first class post, the day of sending if the email is received in full on a business day and on the next business day if the email is sent on a weekend or public holiday.

11. LAW AND JURISDICTION

These terms and conditions and the relationship between you and Gentle Drive shall be governed by and construed in accordance with the Law of England and Wales and Gentle Drive and you agree to submit to the exclusive jurisdiction of the Courts of England and Wales.

12. DELIVERY

 

  • Important information on Royal Mail collection and delivery services during industrial action
     

  • The Communication Workers Union (CWU) has called on its members who collect, sort and deliver parcels and letters to take further national strike action on the following dates:
     

Friday 30 September 2022 and Saturday 1 October 2022

Thursday 13th October 2022

Thursday 20th October 2022

Tuesday 25th October 2022

Monday 28th November 2022

Further dates have also been announced by the CWU for functional strike action which impacts parts of our operation on the following:

Processing, Distribution, International, Collections, Admin: 3rd, 9th, 15th, 24th November and 1st December 2022

Delivery: 4th, 10th, 16th, 25th November and 2nd December 2022

Network: 2nd, 8th, 14th, 23rd, 30th November 2022

  • We will dispatch your order same working day excluding UK bank and public holidays if you order before 1pm. Orders placed over the weekend will be dispatched only on Monday.

  • We continue to advise that you may experience a delay in receiving your orders due to COVID-19.

  • Courier services across UK are usually provided by RoyalMail, therefore no collection or delivery provided on UK public and bank holidays.

  • Please double check your address before placing an order with us as providing wrong or invalid address will cause delays.

  • We will not be held responsible for orders dispatched to wrong/invalid addresses if these were provided by customer during checkout process. In case item is not delivered due to invalid address it will be returned to us and we will contact customer to rearrange redelivery.

    • Delayed/Damaged/Lost items - if you believe your package is delayed/lost/damaged you should contact Royal Mail first and check if they could trace it.

    • If it is most likely that packaged got lost you must make a claim with them using appropriate form. We will happily assist you with information required for submission of a claim.

    • Royal Mail cannot accept a claim for loss unless 10 working days or more have passed since the item was due to be delivered(7 working days Royal Mail Tracked items and 5 working days for Special Delivery Guaranteed)

    • Claims must be made within 80 days of the date they were posted

    • Royal Mail usually provide a full response to claims within 30 days of receiving them, so please allow us this time to investigate before contacting us again

  • Royal Mail 1st class delivery option.
    Please note that Royal Mail 1st class only “aims“ to deliver within 1-2 working days basically weekend doesn’t count. They might deliver on Saturday, but it’s not guaranteed. ​​

  • We strongly suggest our customers the most appropriate delivery option for them depending on order amount and their circumstances. Unfortunately we are not responsible for deliveries directly however we choose Royal Mail for cost price and usually fast and reliable delivery.

13. ​ACCEPTANCE OF YOUR ORDER

​

Please note that completion of the online checkout process does not constitute our acceptance of your offer to purchase products or services from us.
We will notify you by email as soon as possible to acknowledge that we have received and are processing your order. Our acceptance of your order will take place only when we despatch the product(s). Therefore we reserve the right to cancel an order for any reason, including legal and regulatory reasons. In case of your order cancellation by us we will issue refund to you in full as soon as reasonably possible, but in any event no later than 14 days after receipt of your payment.

​14. ​RETURNS AND REFUNDS

​

In accordance with the Distance Selling Act, once you have purchased items online and you decide you no longer want them, you have 28 calendar days to return them and we will refund them in full within 28 days of the cancellation date (including any postage and packing paid) as long as the units packaging remains unopened and undamaged.

​

In case if you believe you have received a faulty item, for instance once opened blue light indicator flashes instantly and unit produces no puff, please contact us.
We might post your prepaid envelop with return address to post it back to us for investigation or request you to  provide pictures/video of faulty item including where possible rear side of outer packaging, that contains batch number. Once we can establish that unit is considered to be faulty manufactured item and issue with it is not caused by a damage or unintended usage caused by customer, we would offer a refund or replacement. If you don't keep the unit (for instance throw it away) unfortunately we won't be able to process your claim.   

15. SUBSCRIPTIONS

​

Customers on our Web Site can buy monthly subscription plans and receive selected quantity of Salt Switch disposable pods once a month.

Advantage of using monthly subscription include 

  • free delivery

  • be first to receive samples of new/upcoming products for free

  • branded Salt Switch gifts and merchandise in case of purchased "Master" plan 

  • saved time as monthly stock is posted ahead of time and users no longer need to be worried about running out of Salts or purchase pods several times a month going through same process multiple times.

After customer(user) makes a payment for subscription plan we will get in touch to ask customer(user) to provide flavours he wants to receive as part of chosen subscription plan in his first month and any subsequent months after. Once selection is made we will post a package with Salt Switch pods using Royal Mail tracked service on provided customers address. 

​

By placing your order for specific monthly “subscription” plan you agree to following terms and conditions:

  1. Subscription will be auto-renewed every month until it is cancelled by customer (user).

  2. Cancelled subscription will be terminated starting from next month and no refund for current month subscription would be issued unless customer(user) returns package received for current month in unused/unopened state without any damage to us back.

  3. Shall customer (user) decide to cancel subscription plan before or after receiving package with Salt Switch pods, we will issue refund excluding postage costs incurred by us to customer's bank account/card only after receiving package in unused/unopened state without any damage.
